WHY HIRE A CANADIAN LAWYER?
There are many benefits to having competent Canadian legal representation in any Immigration matter and you should know that you have the right to hire a lawyer.
Canada is a nation governed by the Rule of Law. Legislative systems regulate virtually every aspect of life in Canada, according to laws passed by our democratically elected representatives. Our tradition of fair and equal treatment of all people under the law is one of the defining characteristics of our national identity.
Canadian Immigration and Citizenship matters are governed by one such legislative system, one of the more complex systems, comprised of many, often confusing, rules and regulations. The Immigration laws are administered by the Citizenship & Immigration Department, which unfortunately is currently under-resourced and over-burdened.
The visa processing system is not as user friendly as it should be, resulting in lengthy processing delays, and long periods of time when the unrepresented applicant is left in the dark, unable to obtain a reply from the visa office to mail, email, fax or phone calls, not knowing where the application stands. This can be very frustrating, especially if you are attempting this process without the guidance of a competent Immigration Lawyer.
In addition, the rules and regulations are subject to change without notice. Many changes often do take place during the processing of an application [which can take anywhere from approximately two years to more than 3 years, depending upon the application category, the visa office handling the application, and whether a visa interview is required or not].
Finally, inconsistent decision-making and the training of visa officers (especially locally hired staff at all Canadian visa offices who are not even Canadian) are problematic issues. You have to be prepared to deal with whatever decision an officer makes, and that often requires not only legal expertise and experience but also tact and diplomacy. A legally qualified expert practitioner can guide you through the process, from start to finish.
